These Terms and Conditions govern your use of butter-squishy.com (the “site”) and every purchase made through it. The site is operated by Julien Ruggia, trading as JRECOM AE, a sole proprietorship registered in France (SIRET 843 776 691 00035), referred to below as “Butter Squishy”, “we” or “us”. By visiting the site or placing an order, you agree to these terms, together with the Shipping Policy, the Return Policy, the Privacy Policy and the Cookie Policy, which form part of them. Please read them before ordering.
1. Online store terms
You must be at least 18 years old to place an order. By ordering, you confirm that you are 18 or older and that the information you provide is accurate. This requirement applies to the person completing checkout and is separate from the recommended user age of our products, which is 14 and up. You agree not to use the site or our products for any unlawful purpose and not to violate any law in your jurisdiction.
2. General conditions
We reserve the right to refuse service to anyone for any lawful reason at any time. Your content, other than payment details, may be transferred unencrypted over various networks as a normal part of the internet; payment information is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell or exploit any portion of the site without our written permission.
3. Accuracy of information
We describe our products as accurately as we can, including materials, dimensions and recommended age, and we state only what the maker declares. The material on the site is provided for general information; we are not responsible if information on the site is not accurate, complete or current, and you rely on it at your own risk. We may change the content of the site at any time, but we have no obligation to update it.
4. Modifications to the service and prices
Prices for our products are subject to change without notice. We may modify or discontinue the site or any product at any time without notice, and we are not liable to you or to any third party for a price change, modification, suspension or discontinuance. A price change does not affect an order you have already placed and paid for.
5. Products
Products are available exclusively through the site and are sold to addresses in the 50 US states only. Quantities are limited and products may be discontinued at any time. We have made every effort to display the colors and images of our products accurately, but we cannot guarantee that your screen’s display of any color will be accurate. Blind box products contain a design drawn at random from the assortment shown on the product page. We reserve the right to limit the quantities of any product per person, per household or per order.
6. Orders, billing and account information
We may refuse, limit or cancel any order at our discretion, for example in cases of suspected fraud, a pricing or listing error, or an item that is no longer available. If we cancel an order after payment, we notify you at the email address provided and refund you in full. You agree to provide current, complete and accurate purchase and account information, including a valid email address and shipping address, so that we can complete your transaction and contact you if needed.
7. Prices and payment
Prices are shown in US dollars and include any applicable customs duties and import taxes. No additional tax or fee is added at checkout and nothing is collected on delivery. Standard shipping is free on orders of $25 or more and costs $3.99 below that, as shown at checkout. We accept major credit and debit cards and PayPal. Payment is processed by our third-party payment providers; Butter Squishy does not store your full card details. Your order is confirmed by email once payment has been accepted.
8. Shipping and delivery
Orders are dispatched in 2-3 business days and delivered in an estimated 5-7 business days after dispatch (typically 7-10 business days total), to street addresses in the 50 US states, with a tracking number sent by email. Delivery times are estimates, not guarantees; carrier delays and holiday peaks can add a few days. Risk of loss passes to you on delivery. The Shipping Policy covers wrong addresses, lost packages and everything else about delivery, and forms part of these terms.
9. Returns and refunds
Returns are accepted within 30 days of delivery on unused items in their original packaging. Change-of-mind returns go to France at the customer’s expense; contact us first for approval and the exact address. Refunds are issued to the original payment method within 7 days after we receive the return, under the conditions on the Return Policy page, which forms part of these terms. Defective, damaged or incorrect items are replaced or refunded in full at our expense. Nothing in this section limits the rights you hold as a consumer under applicable law.
10. Product safety and intended use
Butter Squishy products are recreational sensory and desk toys. They look like food but are not edible and must never be put in the mouth. They are not intended for children under 3, because small parts can come loose and pose a choking hazard, and we recommend them for ages 14 and up. You agree to read and follow the Safety Information page, to keep the products away from young children and pets, and to discard a torn or crumbling squishy. We make no claims about testing or certification on this site.
11. Third-party links and tools
The site may contain links to third-party websites, such as our payment providers or carriers, and may use third-party tools such as analytics. We are not responsible for the content, accuracy or practices of third parties, and we provide access to third-party tools as is, without warranty. Please review the policies of any third party before you transact with it.
12. User comments, feedback and submissions
If you send us comments, suggestions or other material, whether at our request or not, you agree that we may use them at any time and in any medium without restriction or compensation, and that we are under no obligation to keep them confidential. You agree that your submissions will not violate any right of a third party and will not contain unlawful, abusive or misleading material. You are solely responsible for what you submit.
13. Personal information
Your submission of personal information through the site is governed by our Privacy Policy. The cookies and similar technologies used on the site are described in our Cookie Policy.
14. Errors, inaccuracies and omissions
Occasionally there may be information on the site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct any error, inaccuracy or omission, and to change or update information or cancel orders if any information is inaccurate, at any time and without prior notice, including after you have submitted an order. If we cancel a paid order for this reason, we refund you in full.
15. Prohibited uses
You may not use the site or its content for any unlawful purpose; to solicit others to perform unlawful acts; to violate any regulation or law; to infringe our intellectual property rights or those of others; to harass, abuse, defame or discriminate; to submit false or misleading information; to upload or transmit viruses or malicious code; to collect the personal information of others; to spam, phish or scrape; or to interfere with the security of the site. We may terminate your use of the site for violating any of the prohibited uses.
16. Disclaimer of warranties; limitation of liability
We do not guarantee that your use of the site will be uninterrupted, timely, secure or error-free. The site and the products are provided as is and as available, without any representation or warranty, express or implied, other than those expressly stated in these terms or required by law. To the maximum extent permitted by law, JRECOM AE, its owner and its suppliers are not liable for any indirect, incidental, special or consequential damages, including lost profits, arising from your use of the site or of any product, whether based on contract, tort, strict liability or otherwise. Where applicable law does not allow the exclusion or limitation of certain warranties or liabilities, our liability is limited to the maximum extent permitted by law. Nothing in these terms limits liability that cannot be excluded under applicable law, including the rights you hold as a consumer.
17. Indemnification
You agree to indemnify and hold harmless JRECOM AE and its owner, suppliers and service providers from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these terms or of any law or the rights of a third party.
18. Severability
If any provision of these terms is found to be unlawful, void or unenforceable, that provision is enforceable to the fullest extent permitted by law, and the unenforceable portion is deemed severed without affecting the validity and enforceability of the remaining provisions.
19. Termination
These terms are effective unless and until terminated by you or by us. You may terminate them at any time by ceasing to use the site. If, in our sole judgment, you fail to comply with any term, we may terminate this agreement at any time without notice and deny you access to the site. The obligations and liabilities incurred before termination survive it.
20. Entire agreement
These terms and the policies they refer to constitute the entire agreement between you and us regarding the site, and supersede any prior agreements or communications. Our failure to exercise or enforce any right or provision of these terms does not constitute a waiver of that right or provision.
21. Governing law
These terms and any separate agreement under which we provide products are governed by and construed in accordance with the laws of France, without prejudice to any mandatory consumer protection rules of the state where you live.
22. Changes to these terms
We may update, change or replace any part of these terms by posting updates on this page. The version published here, with its “Last updated” date, applies to any order placed after that date. Your continued use of the site after changes are posted constitutes acceptance of those changes.
